Parties and Share Options
Our agreement is between Gregory Family Farms, Inc., and each Customer who both submits our share information and makes a lamb share deposit for the purchase of a live lamb share from the sheep flock owned and managed by Gregory Family Farms, Inc.
Share Purchase Price(based on live weight) Whole: $3.30/lb
Payment Schedule
Deposit: A deposit made payable to GREGORY FAMILY FARMS is due at the time this contract is signed. The deposit is $100 for a whole lamb share, which is credited against your final lamb fee due. Payment of the deposit may be made online through the link provided by email, or may be paid by in-person delivery. Mailed payments are not considered received until actually received at Gregory Family Farms, a real hit-and-miss under our current postal service. There is no convenience fee for online deposits. There is a 3% convenience fee for all other online payments.
Final Lamb Fee: We will notify you by email and/or telephone at the time your lamb is taken to processing to provide you with the total live weight poundage and full purchase price (the “Lamb Fee”). The Lamb Fee is based upon the live weight of your individual lamb as measured by livestock scale within 24 hours prior to slaughter, as well as the processing fee (a flat fee of $125), less your deposit.
[Price Per Pound] x [Live Weight] + [Processing Fee] – [Deposit] = Lamb Fee.
If you pick up your lamb directly from the processor (no delivery), you will pay us the Lamb Fee less processing and will pay the butcher directly for your processing expense. The butcher will not release your lamb until we notify him that the Lamb Fee has been paid to us.
The Final Lamb Fee must be received at or before delivery/pickup and is made payable to Gregory Family Farms. Online payment of the Final Lamb Fee can be set up by request and is subject to the 3% convenience fee.
Delivery
As a separate service, Gregory Family Farms also offers the option of pickup and delivery of inspected lamb shares frozen in coolers. Delivery service is optional, as all customers have the right and opportunity to pick up their lamb directly from the processor, or to utilize another party to pick up their lamb.
We will change these terms only if required to stay in compliance with federal, state, and local agricultural laws and regulations. Notice and explanation of any required change will be provided to all current customers in writing.
Delivery Fees
Gregory Family Farms charges a fee of $40+ per customer for pickup and delivery of lamb shares. Delivery service includes driving to the processor, hand-loading your frozen lamb into our coolers, travel to your delivery site, and assistance unloading your lamb on the delivery date provided in advance.
Gregory Family Farms is not liable for any damage that occurs to lamb shares during delivery, whether the result of accident, temperature, or negligence on the part of Gregory Family Farms or its agents. Because of the distance and materials involved in delivery, if Customer is not present on the delivery date and we cannot contact you or your alternate contact for delivery within one hour of notification, Customer will need to arrange for pickup at our farm within 24 hours of the delivery time. Failure to do so will result in Customer's share being transferred to a Waitlist customer or being utilized on behalf of a nonprofit food bank entity; Customer will remain liable for full payment of the Final Lamb Fee.
Effects of Transfer, Nonpayment, or Bad Payment
Customer may not transfer or assign their responsibility under this contract to any other party without the express written consent of Gregory Family Farms. Gregory Family Farms is not liable for any transfer or sale of lamb between Customer and any other party in violation of state or federal regulations. Customer accepts responsibility for full payment of Final Lamb Fee. Should Customer fail to pay on or prior to the delivery/pickup date specified, Customer's deposit will be forfeited and Customer's share will be offered to a waitlist customer or, in the sole discretion of Gregory Family Farms, utilized on behalf of a Virginia charitable nonprofit food bank or meal program. If customer payment is returned or refused for insufficient funds subsequent to delivery or pickup of the lamb share, Gregory Family Farms shall have all remedies available at law to collect such payment. Should satisfactory repayment be made within 30 days of notice to Customer, the Final Lamb Fee plus a $50 NSF charge shall constitute payment in full. Should legal action be required to receive payment after 30 days from notification, Customer agrees to pay reasonable collection costs and attorneys' fees as well as ten percent (10%) interest from the original email notification date of the Final Lamb Fee.
Lamb Flock
Gregory Family Farms provides hand-selected lambs raised on pasture at location; daily care, and any supplemental or veterinary care as needed while on-farm until delivery at a licensed processing facility. Customer agrees they have had the opportunity to visit, is familiar with and approves of farming methods used by Gregory Family Farms. Because customer is purchasing a share in a specific lamb, the exact final weight and price cannot be determined until the butchering date.
Limitations and Disclaimer
Farming is a high-risk operation in which the final product is an animal, and will have natural variations. Gregory Family Farms sells live lamb shares only. By signing this contract, you agree that neither Gregory Family Farms, its agents or employees are liable for any defect in lamb quality, packing, or any aspect of the product whether through natural causes or through the negligence of Gregory Family Farms, its agents or employees. Consuming raw or undercooked meat creates a risk of illness and food poisoning for which Gregory Family Farms is not responsible. In the event that the lamb(s) representing your live lamb interest become harmed, ill, or otherwise unfit for consumption before being in the possession of the licensed processor, your sole remedy is refund of the monies already paid.
